Wage and Hour Laws
Wage and hour laws exist both on the federal and state level related to wages employees must receive, overtime pay, hours worked, and a variety of similar issues. The Fair Labor Standards Act, for example, sets rules for youth employment, record keeping, minimum wages, and overtime pay- among other related matters. All of these rules must be followed to the letter to avoid government action and costly lawsuits by employees seeking back pay.
Managers and human resource professionals within an organization need to have sufficient training on wage and hour laws to make sure all regulations followed. Training courses should cover:
1. Requirements for paychecks. Regulations address issues ranging from when employees have to be paid on a regular basis to when a final paycheck must be provided when workers quit or are terminated.
2. Rules on meal breaks for employees. There are requirements on when employees must be given meal breaks over the course of a work day, as well as how long the meal breaks have to be.
3. Rules on rest breaks. Employees may be entitled to breaks at various points in the day, depending upon the number of hours worked.
4. Requirements for when an employee is considered on-the-clock or off-the-clock. Managers need to know when the law requires an employee be paid for his or her time.
